CLASSIC CAR AUCTION GROUP, CLASSIC CAR AUCTION TERMS & CONDITIONS:
By accepting the terms and conditions of this auction you acknowledge that you are entering into a legal and binding contract between you and Classic Car Auction Group (CCAG). You agree to abide by and be bound by all terms and conditions herein.
SUMMARY
- All invoices for onsite buyers must be paid on Auction day. Invoices for on-line buyers must be paid by 8/3/26 @ 3PM CST.
- A $1000 Refundable Authorization Hold on a credit card is required to bid.
- Vehicles will be released once funds are received and verified by CCAG. For Onsite buyers, payment is expected the day of the auction. Payment options are outlined in the auction terms and will be provided to buyers on their invoice.
- A Buyer's Premium of 10% for buyers bidding in the lane or online through the CCAG platform will be added to each lot’s high bid to establish the sale price for each lot, $250 minimum.. A buyers premium of 12% for buyers bidding on Proxibid.com will be added to each lot’s high bid to establish the sale price for each lot, $250 minimum.
- $100 Doc Fee will be applied to each vehicle lot, on all vehicle invoices.
BUYER’S PREMIUM
Automobiles - Buyers premium 10% of final accepted bid. $250 minimum.
Memorabilia - Buyers premium 15% of final accepted bid.
BIDDER REGISTRATION
A valid credit card must be on file to place a bid. You must be 18 years of age or older to register and bid. During the registration process, you must submit information found to be current, complete, and accurate for proper identification. You acknowledge that it is your responsibility to continually maintain current and accurate account information. All bids are final and cannot be retracted or removed.
BIDDER DEPOSIT
Deposit Requirements: A $1000 deposit is required before bidding.
- If you ARE NOT the winning bidder on any lot, your deposit is released within 5 days of the completion of the auction.
- If you ARE the winning bidder on any lot, your deposit will be released upon receipt of the full final amount due. If payment is not made by the payment deadline, your deposit will be kept as a non-paying bidder fee.
BIDDER VERIFICATION
The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, CCAG will reject the registration, and bidding activity will be terminated.
RETURNS
All sales are final. There are no returns, refunds, credit card charge-backs or adjustments.
PROCEDURE
Pre-Bidding will be an online only bidding forum with increments as determined by the Auctioneer. Bidding starts at the nominal opening bid indicated and is open to the public. The Auctioneer is the sole arbiter and controller of the conduct of the auction and shall be the final and absolute authority without liability to any party.
CURRENCY TYPE
All bidding increments and payments will be in US Dollars (USD).

LOT DESCRIPTIONS & CONDITION
CCAG offers lot descriptions and condition details as a courtesy to bidders. They are intended to be accurate, but represent opinions only, not statements of fact, and do not imply any warranty concerning condition, or any assumption of liability. Lot announcements, listings, photographs, and catalog information are for descriptive purposes only.
You acknowledge that you have the right and responsibility to inspect each lot personally, or to have a third-party representative inspect the lot for you. By bidding on a lot, you have agreed to accept the lot in its present condition, at its present location and with the description provided, whether accurate or not.
PRE- BIDDING
Bids may be placed online only, manually, one bid at a time or bidders may utilize the Max Bid feature by entering the maximum bid they wish to pay for an item and allowing the software to bid incrementally for them. Occasionally, two different bidders place max bids for the same amount. In this case, the software awards the top bid to the bidder who placed the earliest max bid of that amount.
PAYMENT
At the end of the auction, all successful online bidders will receive an invoice and payment link via email. All invoices must be paid by 8/03/26 @ 3PM CST.
$100 Doc Fee will be applied to all invoices for each titled item.

NON-PAYMENT, THEFT & FRADULENT BIDDING
Non-paying bidders or fraudulent bidding will be subject to legal recourse and possible criminal charges including any theft, fraud and/or interstate commerce violations. Bidders in possession of items they have not paid for will be subject to any and all theft violations. CCAG & AAS has the right to locate and repossess any and all items not paid for in full.

ACCOUNT SUSPENSION & LOSS OF BIDDING PRIVILEGES
If you fail to adhere to these Terms & Conditions, your account with Ascent Auction will be suspended & your bidding privileges will be revoked.
SHIPPING & TRANSPORTATION
Shipping & transportation is the responsibility of the buyer.
POSSESSION
Merchandise becomes the FULL RESPONSIBILITY of the buyer at the close of the auction and the buyer assumes all risk of loss and damage to property at that time. In any such event, the bidder will be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
BIDDING IS NOT CONTINGENT UPON FINANCING
Buyer must have financing arranged, if needed, and be capable of paying cash at closing.
INTERNET, SERVER & SOFTWARE ISSUES
You acknowledge that the internet may be an unreliable and error-prone network. CCAG will not be responsible for technology disruptions, errors or failures including disruptions to bidding or the failure to execute recognized or unrecognized online bids. Regardless of whether it is caused by a loss of connectivity or breakdown of the system, hacking or other reasons, CCAG reserves the right, upon technology disruption, to continue, cancel or suspend the auction.
AUCTIONEERS ANNOUNCEMENT
CCAG and its employees and contractors act merely as agents of the sellers. All auctions are with reserve unless specifically stated otherwise. Reserves, if any, are not disclosed. Bids may be placed by the seller, an employee of the seller, or an agent on the seller’s behalf up to the reserve. CCAG reserves the right to place and accept bids on behalf of internet bidders, absentee bidders, the seller, or themselves. CCAG reserves the right to accept or reject any bid and in all cases of dispute CCAG decision shall be final.
LIABILITY
Preview, bid, and pickup lot purchases at your own risk. CCAG nor any of its officers, employees, independent contractors, or clients, are responsible for injury or damage of any kind, to anything or anyone, while previewing, bidding, picking up purchases, or conducting business. You agree to hold CCAG and its agents harmless regardless of opinion.
LIMITATION OF LIABILITY
If, for any reason, CCAG is unable to make available or deliver any lot purchased, or portion thereof, or documentation required in respect to any lot, the sole liability of CCAG, if any, will be the return of monies paid in respect to such purchase upon the lot’s return to CCAG by buyer.
GOVERNING LAW
This agreement shall be interpreted in accordance with and governed by the laws of the State of Montana, to include but not limited to, the Uniform Commercial Code, as adopted in Montana. The exclusive jurisdiction and venue of any controversy or claim between Parties will be in the County of Gallatin in the State of Montana. In the event that litigation is filed to enforce the terms of this agreement, the losing party in such litigation is responsible to pay the litigation costs and reasonable attorney’s fees incurred by the prevailing party.
TERM OF AGREEMENT
The term of this agreement will begin on the date of this Agreement and will remain in full force and effect until completion of services.
PRIVACY
We respect your privacy and that of our clients, both buyers and sellers. We will not release your information to anyone without your permission. You agree to give CCAG permission to email you promotional materials for future auction events. You can change this preference at any time.
ADDITIONAL TERMS
When the final bid is accepted and the auctioneer announces 'SOLD', the final and highest bidder is the purchaser. In all cases of disputed bids, the Run Number shall be resold, but the auctioneer will use his judgment as to the good faith of all claims and his decision is final.
Purchaser agrees to accept ownership of merchandise/property when the auctioneer announces 'SOLD' and he/she willingly assumes all responsibility and liability for said merchandise/property at that time and without exception.
Purchaser's Agreement: PURCHASER agrees to purchase the Run Number for purchase price of last accepted bid plus applicable buyer's fees; that upon making settlement NO stop payment of funds will be honored; and any stop payment order of check or giving a check which is returned marked 'insufficient funds' shall be deemed by the parties to be prima facie evidence of Fraud existing at the time the transaction was consummated and shall be construed by the parties as an intent to defraud in order to consummate the transaction.
ALL bids are to be per run# unless otherwise mentioned by the Auctioneer.
Invoicing and titling on purchases will be processed according to the contact information provided on the Bidder's Registration form. Only the registered bidder can sign as purchaser on the contract. Funding can be provided by another party as long as all contact information is provided and approved by CCAG.
All items are offered for sale by Run Number under both reserve and no-reserve status. The auctioneer will accept bids from the bidders present in the room, absentee bidders, or absentee bidders who leave written bids in advance of the auction. The auctioneer has the right to place a bid for the consigner up to the reserve amount. Further the consignor has the right to 'lift' the reserve price whereupon it will be sold to the last highest bidder when the auctioneer announces 'SOLD'. When the reserve has been lifted, the auctioneer will duly announce it.
The seller will afford every opportunity to view all lots prior to sale. However the purchaser must understand that he/she is buying property entirely upon his/her own or his/her agent's personal examination, inspection and opinion. All lots are sold 'AS IS, WHERE IS,' with all faults and defects. Any guarantees written or implied as to the authenticity, originality, or condition of any lot are not the guarantee of the CCAG, and should be determined by the purchaser's own inspection and discretion. The vehicle and information presented at the time of auction is final and supersedes any previous representations. The information provided is deemed reliable, but is not guaranteed.
Should any dispute arise after the sale, the auctioneer's records shall be conclusive in all respects.
CCAG is not responsible for lost, stolen or damaged properties. Purchased Run Numbers must be removed from the auction site by the days end of the auction. If not claimed, the CCAG has the right to remedy, move and store at owner's expense.
CCAG is not responsible for any and all liabilities.
CCAG is entitled to any and all fees or commissions on any run number sold, due to or presented at an auction event immediately after said event and payment in full must be made before any removal of any purchased vehicle.
CCAG shall be entitled to any Attorney's Fees incurred in the enforcement of this contract or the enforcement of Sell/Buy Agreement.
Upon being awarded high bid, purchaser is responsible to pay the final accepted bid price plus any applicable buyer's premiums. Non-payment will deem purchaser liable for any losses incurred in the resale of said lots to include, but not inclusive of freight, storage, deliverance in received value or auction fees.
Purchaser authorizes, without further notice, CCAG to recover any deficiencies due to seller and/or CCAG and to charge purchaser's credit card for said amount(s).
If the purchaser fails to comply with any of these General Rules and Terms, CCAG may, in addition to asserting all remedies available by law including the right to hold such defaulting purchaser liable for the purchase price (i) cancel the sale, retaining as liquidated damages any payment made by the purchaser, (ii) resell the property without reserve at public auction or privately on seven days notice to the purchaser or (iii) take such action that we deem necessary or appropriate. If CCAG resells the property, the original defaulting purchaser shall be liable for the payment of any deficiency in the purchase price and all costs and expenses, including warehousing, the expense of both sales, responsible attorney's fees, commission, incidental damage and all charges due hereunder. In the event that such purchaser pays a portion of the purchase price for any or all vehicles purchased, CCAG shall apply the payment received to such vehicles that CCAG, in our sole discretion, deems appropriate. Any purchaser who fails to comply with these General Rules and Terms will be deemed to have granted CCAG a security interest in, and CCAG may retain as collateral security for such buyer's obligation to CCAG any property in CCAG's possession owned by such a purchaser. CCAG shall have benefit of all rights of a secured party under the Uniform Commercial Code adopted in the state where the auction is held.

If the car does not sell, you are able to check in at the SELLERS area to have your car taken to the Exit Gate following the sale. Please give our office at least 30 minutes before checking in so we have time to process the paperwork so you can retrieve your products. Your vehicle must be pulled to the Exit Gate by our staff. Vehicles need to be removed from the Denny Sanford Premier Center by Sunday, August 2nd by 12noon. Vehicles left at the Auction Facility following the auction are the responsibility of the owner.
Vehicles will be released once funds are received and verified by Classic Car Auction Group.
